1) Parties and Scope

These Terms of Service (“Terms”) govern your use of this HELOC funnel website and any related intake forms, calls, texts, emails, and services made available through it (collectively, the “Site” and “Services”). The Services are provided by Assets & Equity LLC of Nevada acting as a mortgage broker and operating under West Capital Lending, Inc. where applicable.

By accessing or using the Site, you agree to these Terms. If you do not agree, do not use the Site.

2) Eligibility

You represent that you are at least 18 years old and legally able to enter a binding agreement. The Site is intended only for use in jurisdictions where we and our lender partners are properly licensed and where website approvals, if required, are in place.

New York notice: This site is not authorized by the New York State Department of Financial Services. No mortgage loan applications for properties located in New York will be accepted through this site.

3) Relationship; Broker Status

We act as a mortgage broker, not as your lender. We arrange loans with third-party lenders and do not make credit decisions. Eligibility, pricing, and product availability are set by the lender and subject to change until closing. References to specific lenders or products, including but not limited to digital HELOCs offered by partners such as Figure, NFTY, or others, are for convenience only and do not imply control, agency, or endorsement.

4) No Commitment; Preliminary Information

Any rates, terms, timelines, calculators, or scenarios shown on the Site are informational and not a commitment to lend. Final terms depend on underwriting, verification of information, property eligibility, title review, and signed lender disclosures. Not all applicants will qualify.

5) Privacy; Data Use

Your use of the Site is also governed by West Capital Lending’s Privacy Policy and any privacy disclosures we provide in the funnel. By using the Site, you consent to our collection, use, and sharing of information as described in those documents, including sharing with lender partners and service providers to evaluate and process your inquiry. California residents may have additional rights, including the right to opt out of certain sharing as defined by law.

6) Credit, Income, and Identity Verification

Credit inquiries: We may obtain your credit data. Prequalification may use a soft inquiry. If you proceed with an application, a hard inquiry may be required by a lender.

Income and asset verification: You authorize us and our partners to use third-party verification tools such as Plaid or similar services to retrieve income, employment, or account data from financial institutions.

Identity verification: You authorize the use of e-signature, e-consent, and, where applicable, remote online notarization or e-notary.

7) E-Signature, E-Consent, and E-Notary

By using the Site, you consent to receive and sign disclosures and documents electronically, and where available, to complete notarization via approved e-notary platforms. You may withdraw e-consent by notifying us, but doing so may delay or prevent completion of your application.

8) Right of Rescission

Certain owner-occupied HELOCs may include a three-business-day right of rescission after signing lender documents. Whether a rescission right applies depends on the specific product and law. Your lender disclosures will explain if and how a rescission period applies.

9) Communications; TCPA/SMS Terms

By submitting your information, you consent to be contacted by us and our service providers at the telephone number and email you provide, including by calls, emails, and text messages using an automatic telephone dialing system or prerecorded voice, for application updates, document requests, and marketing. Message frequency varies. Message and data rates may apply.


Text HELP for help. Text STOP to opt out of SMS at any time. Carriers are not liable for delayed or undelivered messages. Your consent is not required to obtain services; you can opt out and still proceed through alternative channels.

10) Website Content; Third-Party Links

We strive for accuracy but the Site may include errors or become outdated. Third-party sites or tools we link to are not controlled by us. Your use of those sites is at your own risk and subject to their terms.

11) Intellectual Property

All Site content, trade names, trademarks, logos, text, graphics, and software are owned by us or our licensors and are protected by law. You may not copy, modify, distribute, reverse engineer, or create derivative works except as allowed by law or with our written consent.

12) Acceptable Use

You agree not to:
a) access data not intended for you; b) probe or breach security; c) introduce malware; d) overload or disrupt the Site; e) send unsolicited commercial messages using the Site; or f) attempt to reverse engineer Site software. We may suspend or terminate access for violations.

13) User Content and Feedback

If you submit content or feedback, you grant us a nonexclusive, worldwide license to use, reproduce, modify, and display it to operate and improve the Services. Do not submit content that is unlawful, infringing, or abusive.

14) Availability and Changes

The Site may be unavailable due to maintenance or events beyond our control. We may modify or discontinue any part of the Site or Services at any time. Submissions already made will continue to be evaluated, and existing transactions will remain subject to their agreements.

15) No Warranties

THE SITE AND SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED OR ERROR FREE.

16) Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE AND OUR AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SITE OR SERVICES, EVEN IF ADVISED OF THE POSSIBILITY. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED ONE HUNDRED DOLLARS.

Some jurisdictions do not allow certain limitations. In those jurisdictions, liability is limited to the greatest extent permitted by law.

17) Indemnification

You agree to defend, indemnify, and hold harmless us and our affiliates, officers, directors, employees, and agents from and against claims, losses, damages, liabilities, and expenses, including reasonable attorneys’ fees, arising out of your use of the Site, your violation of these Terms, or your infringement of any rights of a third party.

18) State Notices

If required by applicable states, we will provide additional state-specific notices in your disclosures.
Texas notice: The Department maintains a recovery fund to make payments of certain actual out-of-pocket damages sustained by borrowers caused by acts of licensed residential mortgage loan originators. For information, see the Department’s website at www.sml.texas.gov.

19) Governing Law; Venue

These Terms are governed by the laws of the State of California and applicable federal law, without regard to conflict-of-law provisions. You agree to the exclusive jurisdiction and venue of the state and federal courts located in Orange County, California for disputes arising from these Terms or the Site.

20) Severability; Waiver

If any provision is found unenforceable, the remaining provisions will continue in effect. No waiver of any term is a continuing waiver unless stated in a signed writing.

21) Modifications to These Terms

We may update these Terms at any time. We will post the revised Terms with a new effective date. Your continued use after changes are posted constitutes acceptance.

A Figure HELOC is secured with your home as collateral, whereas personal loans and credit cards are not.

To check the rates and terms you qualify for, we will conduct a soft credit pull that will not affect your credit score. However, if you continue and submit an application, Figure will request your full credit report from one or more consumer reporting agencies, which is considered a hard credit pull and may affect your credit.

Approval may be granted in five minutes but is ultimately subject to verification of income and employment, as well as verification that your property is in at least average condition with a property condition report.

The five-business-day funding timeline assumes closing the loan with Figure’s remote online notary. Funding timelines may be longer for loans secured by properties located in counties that do not permit recording of e-signatures, require in-person closings, or impose waiting periods prior to closing.

The Home Equity Line by Figure Lending LLC is an open-end product where the full loan amount (minus the origination fee) is 100% drawn at origination. The initial draw carries a fixed rate; however, this product contains an additional draw feature. As the borrower repays the balance, additional draws may be made during the draw period. The rate for each additional draw is based on the Prime Rate published in the Wall Street Journal for the preceding month plus a fixed margin and may be higher than the initial rate.
